Terms of service

These Terms of Service ("Terms") govern the relationship between WebDesignbyTomi ("Service Provider", "we", "us") and the client ("User", "you", "your") when using our web design services and related services.
By using our services or website, you confirm that you have read, understood and agree to these Terms.
1. Definitions
- "Services" - web design, web development, SEO optimization, hosting and technical support services provided by WebDesignbyTomi
- "Project" - a specific task or set of tasks agreed upon between the Service Provider and the User
- "Delivery" - the completed website or other agreed-upon product
- "Content" - text, images, logos and other materials provided by the User for the project
2. Description of services
2.1 Service packages

2.2 What is included in all packages
- Responsive design (optimized for all devices)

- Full source code handover
Code ownership
Unlike many other providers, you become the full owner of your website's source code. You are not tied to us - you can move the site to any hosting or hire another developer.
3. Order and development process
3.1 Steps
- Contact and consultation - We discuss your needs free of charge
- Proposal - We provide a detailed proposal with pricing and deadlines
- Acceptance and deposit - Upon accepting the proposal, a 50% deposit is due
- Mockup creation - Design proposal for your feedback
- Revisions - Up to 3 rounds of changes included in the price
- Development - Coding and building the functional website
- Testing - Testing on various devices and browsers
- Launch - Website goes live and access credentials are handed over
- Final payment - Payment of the remaining 50% upon completion
3.2 Delivery timelines
- Starter package: 7 business days
- Standard package: 10-14 business days
- Premium package: 14-21 business days
Timelines may vary depending on project complexity and how quickly the User provides materials.
4. Payment
4.1 Payment terms
- Deposit: 50% of the total price before work begins
- Balance: 50% upon project completion, before the website goes live
- Payment deadline: 7 days from invoice issuance
4.2 Payment methods
- PayPal
- Cryptocurrency (BTC, ETH, USDT)
- Bank transfer - by arrangement
4.3 Prices
All prices are expressed in euros (€). We are not registered for VAT, therefore VAT is not charged. Prices are fixed for the agreed scope of work - no hidden costs.
5. User obligations
The User agrees to:
- Provide all required materials (text, images, logo) within the agreed timeframe
- Ensure that provided materials do not infringe third-party copyrights
- Provide feedback on the mockup within 5 business days
- Make payments according to the agreed terms
- Provide accurate contact details
Delay in providing materials
If the User is more than 14 days late in providing required materials without notice, we reserve the right to extend the delivery deadline or put the project on hold until we receive the necessary materials.
6. Service Provider obligations
We commit to:
- Deliver the service according to the agreed scope and quality
- Respect the agreed deadlines
- Communicate regularly about the project status
- Maintain confidentiality of all User information
- Provide technical support during and after development
- Hand over the complete source code without restrictions
7. Revisions and changes
7.1 Included revisions
- Starter: 3 rounds of revisions
- Standard: 6 rounds of revisions
- Premium: 18 rounds of revisions
7.2 Additional revisions
Revisions beyond the included number are charged at 30 € per hour. Before additional work begins, the User will be notified and must confirm to proceed.
7.3 What counts as a revision
A revision includes minor changes to design, text or layout of elements. Significant concept changes or adding new functionality are considered additional work.
One major revision (e.g., change of design direction) is always included in the price. Additional major revisions are at the discretion of the Service Provider.
8. Intellectual property
8.1 User ownership
Upon full payment, the User acquires:
- Full ownership of the website's source code
- Right to use, modify and distribute
- Ownership of all custom graphic elements created for the project
8.2 Retained rights of the Service Provider
- Right to use the project for portfolio purposes (unless the User explicitly requests otherwise)
- Ownership of generic components and libraries used across multiple projects
8.3 Third-party materials
Stock photos, icons and fonts used in the project are subject to their respective licenses. We will ensure that all components used have appropriate licenses for commercial use.
9. Hosting and domain
9.1 First year
All packages include hosting and domain for the first year. The domain is registered in the User's name.
Note for .hr domains: Registration of a .hr domain is only possible if the User is entitled to a free domain through a sole proprietorship, company or other legal basis. We recommend that the User registers the domain themselves, but we can do it with the necessary documentation.
9.2 Renewal
- Hosting: 60-90 €/year, depending on website size
- Domain: depending on TLD (typically 10-15 €/year for .com and similar)
We will notify you 30 days before expiration. Renewal is not mandatory - you can move the website to your own hosting.
9.3 Annual maintenance
After the first year expires, we offer annual maintenance packages that include hosting, technical support and minor changes:

What maintenance includes:
- Hosting and SSL certificate
- Regular security checks
- Minor text and image changes (up to 30 min per month)
- Technical support via email
- Website backup
10. Technical support
10.1 Included support
- Starter/Standard: Email support, response within 48 hours
- Premium: Priority support, response within 24 hours
10.2 Scope of support
Free support includes:
- Help with technical issues
- Minor text changes (up to 30 min per month)
- Usage advice
Major changes, new features or redesigns are charged by arrangement.
11. Limitation of liability
WebDesignbyTomi is not liable for:
- Loss of revenue, data or business opportunities
- Issues caused by third-party hosting (after transfer)
- Changes made by the User after delivery
- Content published by the User on the website
- Unauthorized access caused by weak passwords or User negligence
Maximum liability is limited to the amount paid for the service.
12. Satisfaction guarantee and refunds
100% Satisfaction guarantee
Your satisfaction is our top priority. If for any reason you are not satisfied with our work, we will refund your money - no complications.
12.1 Refunds
The User may request a refund at any time:
- Before work begins: Full refund of the deposit
- During development: Full refund if you are not satisfied with the project direction
- After delivery: If the final product does not meet the agreed specifications, we offer corrections or a full refund
Exception: For Premium projects with 80+ hours of work invested (equivalent to two weeks of full-time work), the refund amounts to 50% of the paid amount. This applies only in extreme cases and after transparent communication about the time invested.
Our goal is long-term collaboration and referrals, not retaining unsatisfied clients.
12.2 Termination by the Service Provider
We reserve the right to terminate if the User:
- Fails to make payment within 14 days of the due date
- Requests creation of content that is illegal or unethical
- Systematically disrupts work through inappropriate communication
13. Confidentiality
Both parties agree to maintain the confidentiality of all information exchanged during the collaboration. This includes business data, technical specifications and financial terms. The confidentiality obligation continues even after the collaboration ends.
14. Force majeure
Neither party shall be liable for delays or failure to fulfill obligations caused by circumstances beyond reasonable control (natural disasters, wars, pandemics, infrastructure failures, etc.).
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Croatia. In case of a dispute, the parties will endeavor to resolve the dispute amicably. If this is not possible, the competent court is in Zagreb.
16. Changes to the Terms
We reserve the right to amend these Terms. Changes take effect 30 days after publication on the website. For active projects, the Terms in effect at the time of proposal acceptance apply.
